How School Discipline Impacts Students’ Social, Emotional and, Academic Development (SEAD)

What is school discipline.

Last year, Mississippi schools used corporal punishment 4,300 times — and the impact affects more than the students experiencing the abuse. According to one parent in Madison County School District, her son’s perception of safety in school changed after seeing another student get paddled in his classroom. This is a prime example of harsh school discipline practices, which can harm students’ social, emotional, academic, and in some cases, physical health. These practices must be reformed.

In general, school discipline refers to the rules and strategies applied in school to manage student behavior and support students in developing self-management skills. Informed by national, state, and local laws, school discipline encompasses a wide range of policies and practices — from those that are positive and evidence-based in supporting holistic development, such as restorative justice and Positive Behavioral Interventions and Supports (PBIS); to practices that are most harmful, including discriminatory codes of conduct, expulsions and in- and out-of-school suspensions, corporal punishment, seclusion, restraint, and other punitive and exclusionary measures.

School discipline policies are broadly intended to foster a high-quality learning environment by maintaining safety in the classroom; however, far too often, schools adopt measures that harm a student’s social, emotional, academic, and in some cases, physical health and well-being.  

To create physically safe and emotionally supportive environments for all students, schools must adopt evidence-based approaches such as restorative justice that can be used to build and repair relationships while also holding students accountable for their actions. When positive discipline policies and practices use a race-equity lens and are fairly implemented, these efforts can not only create safe and inclusive learning environments, but also support students’ holistic development.  

The Impact of School Discipline

School discipline policies and practices are a critical part of creating a school’s overall climate. Choosing harmful practices can result in short and long-term negative impacts on students’ social, emotional, and academic development (SEAD), whereas other, evidence-based practices can support a students’ holistic development and well-being.  

Although the rules may be intended to be applied equally regardless of a student’s race, gender, sexual orientation, socioeconomic status, disability status, or other personal characteristic, harmful school discipline policies are often disproportionately used on underserved students, particularly students of color and students with disabilities. Harsh discipline practices, such as corporal punishment, restraint, and seclusion can result in serious and life-threatening physical injuries. These and other practices, such as hardening measures (e.g., metal detectors and school police) and exclusionary discipline (e.g., suspensions and expulsions), create even more academic and psychological harms and have been linked to the school-to-prison pipeline.  

While districts and schools are supposed to reserve these various school discipline policies for serious offenses, many also employ these measures for minor and subjective infractions, including dress and hair code violations , talking in class, truancy, tardiness, “willful defiance,” and more. In many instances, students of color and students with disabilities are targeted for these minor offenses in ways that attack their cultural identity and strip them of their rights to a safe, healthy, and inclusive learning environment.  

Improving School Discipline Beyond Covid-19

The impact of the COVID-19 pandemic continues to take a toll on students’ mental health and well-being. The National Center for Education Statistics found that 56% of school leaders said the pandemic led to increased classroom disruptions from student misbehavior. And 48% said it led to more acts of disrespect toward teachers and staff.  

Even though school leaders have reported a dramatic uptick in students “acting out,” it is not without valid reasons. Whether it’s the devastating impact of losing a loved one, or the disruptions to routines, relationships, and learning environment due to months-long quarantines, the pandemic resulted in economic and health challenges, increased stress, social isolation, and anxiety for students. It’s no surprise the COVID-19 pandemic deeply affected student behavior in school.  

As reports demonstrate , school staff has had increasing challenges with responding to student behavior. While stricter school discipline policies are broadly intended to foster a safe and manageable learning environment, discipline is far too often used in ways that further harm students’ social, emotional, academic, and in some cases, physical and mental health and well-being.  

How to Evaluate a State’s School Discipline Policies

School discipline practices are determined by policies at all levels — federal, state, district, school, and even in individual classrooms. State leaders can have strong influence in how districts adopt and implement school discipline practices and policies by:  

  • Creating clear goals
  • Adopting evidence-based guidance and policies
  • Publicly reporting discipline data

In 2022, building on Ed Trust’s 2020 seminal report titled, Social, Emotional, and Academic Development Through and Equity Lens, in partnership with CASEL, Ed Trust released Is Your State Prioritizing Social, Emotional, and Academic Development? , a 50-state scan that shows how states support the social, emotional, and academic needs of students in their discipline policies, as well as four other key policy areas:  

  • Professional development
  • Rigorous and culturally sustaining curriculum
  • Student, family, and community engagement
  • Wraparound services

Educators, advocates, and policymakers at all levels of government can use the 50-state scan to evaluate how their state’s school discipline policies compare to other states in holistically creating safe, supportive, and inclusive environments for students.  

Implementing Fair and Positive Discipline at the Local Level

A crucial part of implementing positive discipline practices with fidelity is ensuring all adults in schools and districts develop a race equity lens with which to implement those skills. A long history of research in school discipline shows that disproportionate disciplinary outcomes for students of color are not due to differential rates of behavior, and that the role of discrimination and bias in discipline outcomes must be taken seriously. Furthermore, research shows that using an approach that is racially and culturally conscious is the key to addressing disparities in discipline. A race-equity approach should therefore be embedded in all actions districts take to address discipline policies and practices.  

For actionable guidance, district leaders can use the toolkit from the Alliance for Resource Equity (ARE), a partnership between Ed Trust and Education Resource Strategies. ARE has developed a series of tools and guidebooks that outline specific actions to create a more equitable student experience, starting with a diagnostic tool that identifies areas for growth in a district’s current policies and practices. Then, district leaders can then reference the guidebook on creating a positive and inviting school climate that demonstrates how to further these goals. In particular, district leaders should consider the following key question in the ARE diagnostic tool and guidebook:  

Does each student experience a safe school with transparent, culturally sensitive, and consistently enforced rules and discipline policies?  

Decisions at the local level can ensure that state and federal discipline policies are implemented with fidelity or can even go beyond current policies by utilizing better or more evidence-based practices. District leaders have the power to set equity-focused policies and develop educator capacity for implementing positive discipline practices. These actions can create positive and inviting school climates where students feel safe and are held accountable for their actions in ways that best support their social, emotional, and academic development.

The two most important influences in this regard are the home and the school.

If we look at the students of today. we find a picture of indiscipline. Unlike their ancient counterparts, they lack respect for elders and for their teachers. Their indiscipline is further manifested in dishonesty in examinations. where mass copying has become the order of the day. Invigilators are intimidated at the point of a knife and sometimes even assaulted if they try to perform their duty. This indiscipline is further shown in students going on strike at the slightest provocation and this provocation might be the simplest of reasons such as an increase in the bus fare or the demand for a better canteen and so on. They even go to the extent of taking their anger to the road and stoning and burning buses.

The important point to consider in this state of affairs are the reasons for this growing menace of indiscipline so that a solution can be found to this problem. Now, the two most important influences on the student are his environment at home and at school.

On the home front, parents are to blame to some extent, for pampering the child and giving in to every demand. This causes the child to rebel whenever he is not able to get his way. Again, in most homes, both parents are away at work and have little time to spare for their children, so they feel neglected and turn their minds to mischief.

At the same time, the school also plays a very important role in forming the character of a child. We find that except for missionary schools, no other school has a moral-science class where students are taught basic traits of a good honest life. This, I feel, is a very serious shortcoming of our schools.

Again with the increasing population, the number of students seeking admission to schools is far beyond the number a school can safely admit. TOPEKA, Kan. (AP) — Educators in Kansas’ largest public school district discriminated against Black and disabled students when disciplining them, according to the U.S. Department of Justice, which announced an agreement Tuesday that will have the district revising its policies.

Changes the Wichita district has agreed to include restraining unruly students less often and ending the practice of putting misbehaving students alone in rooms by Jan. 1, 2025, the DOJ said.

The district also agreed to offer counseling or tutoring to every student who was confined alone in a room during the past three schools years, with the number of hours matching those for which the student was secluded. The department said the district already is writing a new code of conduct for students and has scheduled crisis-prevention training for staff.

The agreement comes amid an ongoing national debate about classroom discipline and whether punishments for minority and disabled students are disproportionately harsh. The Justice Department has previously reached similar agreements with other school districts in the U.S.

The settlement “sends a powerful message to Kansas schools and schools across the nation to ensure that they must no longer alienate or target Black students or students with disabilities,” said Rocky Nichols, executive director of the Disability Rights Center of Kansas.

The Department of Justice said in a letter to the Wichita district’s attorney that it investigated disciplinary practices for the past three school years and visited the district in March 2023. It concluded that the district disciplined Black students more often and more severely than white students.

The DOJ also said that in the more than 3,000 times over three years that the district restrained or secluded students, 98% of those students were disabled. And it noted that hundreds of the cases involved students in kindergarten, first or second grade. More than 40 students were restrained or secluded more than 20 times each, the DOJ said.

“We substantiated allegations that the District discriminated against Black students in its administration of school discipline and referral of student conduct to law enforcement,” the department said in its letter. “We also found evidence that the District denied students with disabilities equal opportunity to participate in or benefit from its education program.”

The Wichita district has more than 46,000 students, nearly 10% of all students in Kansas. About 64% of the students are Black, Hispanic or have multiple ethnicities, according to State Department of Education figures, and the state considers nearly 78% to be at risk of failing academically.

The DOJ said the district cooperated throughout its investigation and had “expressed a desire to make positive improvements.”

“We can and must create a more equitable school district by changing some of our practices and procedures,” Superintendent Kelly Bielefeld said in an online statement after the Wichita school board approved the agreement. “Safe learning communities — for students and staff — will always be of the utmost importance.”

Disability rights advocates in numerous states for years have criticized restraints and seclusion for disabled students, saying the punishments are overused and dangerous.

In 2022, Iowa’s second-largest school district promised to end the use of seclusion rooms after the Department of Justice concluded that it had violated the federal Americans with Disabilities Act. In 2023, Alaska’s largest district agreed to stop secluding students and to use restraints only when there is a real risk of physical harm to the student or others.

Kansas law already dictates that restraint can be used only when there is an imminent risk that students will seriously harm themselves or others, according to Nichols.

“Wichita public schools should have been following that requirement all along,” he said.

In other states, pressure to do more about unruly students has led officials to go in a different direction.

Arkansas last year expanded its restraint law so that — in addition to teachers — other school staff can restrain students in some cases. Some states still allow corporal punishment: A southwestern Missouri district reinstituted student spanking in 2022 as a form of discipline, but only in cases where the parents agree.

In Wichita, the Department of Justice said, the difference in discipline for Black and white girls was “particularly pronounced.” At one middle school, Black girls faced being punished for insubordination 4.5 times as often as white girls and were cited for dress code violations 3.6 times as often, the DOJ letter said. Wichita schools restrained students 1,570 times over three years and put them in seclusion 1,450 times, the letter added.

“We concluded that most of the District’s restraints and all its seclusions were improper under both District policy and generally accepted practice,” the letter said.

A Lehigh University student with a full scholarship pleaded guilty to a forgery change and was expelled after admitting online that he faked admissions documents and used ChatGPT to write his essay.

Aryan Anand, 19, was expelled from the private Pennsylvania university this spring after falsifying documents, including his father’s death certificate, tax documents and an email address to impersonate a school principal, according to a report from the Northampton County District Attorney’s Office obtained by Inside Higher Ed .

“Lehigh University revoked his status as a student and his admission was rescinded,” a university spokesperson said in a statement to Inside Higher Ed . “A thorough investigation by Lehigh University police revealed significant fraudulent materials submitted for admission, leading to charges.” 

Anand was admitted to Lehigh in August 2023 and shortly after created a post on the social media site Reddit titled “I have built my career and life on lies.” In the post, he detailed his fabrications of multiple documents to gain a full-ride scholarship to the university. 

A Reddit user sent the post to the Lehigh University Police Department, which conducted an investigation and found the claims were true. 

Anand was arrested in April and faced multiple charges that could have resulted in more than 30 years in prison. Last month, he pleaded guilty to one count of forgery. Lehigh officials decided to not seek restitution, which totaled roughly $85,000, on the condition he return to his home in India. 

Anand admitted to using ChatGPT to write his admissions essay, according to The Hindustan Times . He applied to several universities and got rejected from Ivy League institutions but was successful with Lehigh University.

Kansas' largest school district was discriminatory in its discipline, Justice Department says

An exhaustive investigation into Kansas’ largest school district found it disciplined Black and disabled students more frequently and harshly than their white counterparts, the Justice Department said Tuesday, announcing a settlement agreement with the district. 

The Justice Department investigated Wichita Public Schools and “uncovered discriminatory treatment of Black students in the administration of discipline at multiple schools,” it said in a release Tuesday.

The probe into the district’s 87 schools and special programs from the start of the 2020-21 school year through the end of the fall semester of the 2022-23 school year found that Black girls faced “especially highly levels of exclusion” for dress code violations or “perceived insubordination” and that their behavior was frequently characterized using “stereotypical terms like ‘attitude’ or drama’” the release said.

The probe also found “evidence of racial discrimination” in referrals to law enforcement and “a pattern of security officers responding to routing discipline matters and escalating those incidents, resulting in the unnecessary referral of Black students to law enforcement for routine or minor misbehavior."

The district also “repeatedly secluded and restrained” students with disabilities as punishment or in response to noncompliance with school rules and staff orders. 

In fact, students with disabilities received more than 98% of the district’s roughly 3,000 restraints and seclusions — meaning putting children in rooms alone — during the investigation period, and at least 44 students experienced “20 or more restrains and seclusions” during the period covered by the investigation, the release said. 

One student was restrained or secluded a startling 144 times — including 99 seclusions lasting over 15 hours total, the statement said. 

Overall the district’s schools and settings for students with disabilities lacked student behavior interventions or failed to implement them. Even starker, the district’s special schools for students with behavioral disabilities were found to be “inferior facilities devoid of furniture, educational equipment and the kinds of decor commonly found in schools, and staff who could not meet the needs of the students,” the department said.  

Under the settlement, Wichita Public Schools will have to improve their care for disabled students, including by getting rid of seclusions as a punishment, offering counseling for students who have been repeatedly secluded and restrained and creating an office to monitor restraint practices and ensure staffers are providing students with interventions and support. 

Furthermore, the district will create district-level monitoring of schools to ensure nondiscrimination in discipline, it must ensure school security staff members and law enforcement get involved only in “appropriate circumstances,” and it must standardize dress code policies.  

“Schools in our communities should not be a place of fear or mistrust. This agreement upholds our core principles of ending the school to prison pipeline and protecting our most vulnerable students against all forms of discrimination and segregation,” Assistant Attorney General Kristen Clarke of the Justice Department’s Civil Rights Division said in the release.

Changes must be in place by Jan. 1.

Wichita Schools Superintendent Kelly Bielefeld said in a statement : “We can and must create a more equitable school district by changing some of our practices and procedures. The settlement agreement with the DOJ will end the use of seclusion, create a new Student Code of Conduct, and provide clarity and consistency for staff, students, caregivers and our community regarding disciplinary practices.”

“Together, we will continue to do and be better for our students,” he added.

The Education Department released new guidance this week providing borrowers with key updates on student loan forgiveness, income-driven repayment plans, and Direct loan consolidation. The new information follows multiple court rulings that threatened to throw the entire federal student loan system into disarray.

Two federal courts blocked aspects of President Joe Biden’s SAVE program last week, a new income-driven repayment plan that lowers payments and provides loan forgiveness in 10 to 25 years, depending on the borrower’s specific circumstances. The injunctions halted plans to implement a more favorable repayment formula under SAVE, which would have reduced monthly payments for an estimated three million borrowers, and blocked student loan forgiveness.

Only a few days later, the 10th Circuit Court of Appeals halted one of those injunctions, allowing lower payments under SAVE to proceed, for now. The Education Department is in the process of appealing the second injunction blocking student loan forgiveness.

In the midst of these rapid developments, the administration released updates for borrowers. Here’s a breakdown.

Reduced Student Loan Payments Under SAVE Are A Go — For Now

“The courts have allowed Federal Student Aid to continue implementing the majority of the provisions of SAVE,” says the new Education Department guidance following the 10th Circuit’s ruling on Sunday staying the Kansas injunction. “Many of the cost-savings provisions of the SAVE Plan remain in effect.”

Borrowers who are already enrolled in SAVE and were set to have their monthly payments recalculated should be able to start paying either later this month or in August. Any associated administrative forbearance should end by next month, as well.

“If you are already on the SAVE Plan, no action is needed,” says the guidance.

Limited Information On Student Loan Forgiveness Updates

While lower monthly payments under SAVE can proceed following the 10th Circuit’s stay, the situation remains murkier on the status of student loan forgiveness under the program. The Missouri injunction blocks the Education Department from implementing loan forgiveness under SAVE, but the scope of that order remains unclear.

“If you can’t afford your loans, take a look at the information on loan forgiveness and other options on our Repaying Student Loans 101 page,” says the department’s guidance, the only reference to student loan forgiveness on the new website.

This is likely because the status of student loan forgiveness under SAVE remains very much in flux. Education Department officials believe that the Missouri injunction only pertains to early student loan forgiveness (sooner than 20 or 25 years), a unique feature of SAVE designed to benefit borrowers who took out relatively small amounts of debt. But the wording in the Missouri court order could be interpreted to block any student loan forgiveness under the plan.

The department is seeking clarification on the Missouri court order, and ultimately plans on appealing the injunction to the 8th Circuit Court of Appeals.

“We will update this page with new information as it becomes available,” says the department website.

Student Loan Consolidation And IDR Applications Should Go Back Up For Online Submissions

Following last week’s court orders, the Education Department took down online applications for IDR plans and Direct loan consolidation. Officials anticipated needing to revamp these online applications in order to comply with court orders, which could take weeks. However, following the 10th Circuit ruling, the department is working to restore online access to these applications.

“You can still enroll in the SAVE Plan or another IDR plan and/or request a Direct Consolidation Loan by submitting a PDF application to your servicer” while the online applications are unavailable, says the department in its guidance. That PDF application can then be sent to the borrower’s loan servicer by mail, fax, email, or online upload.

As of this writing, the online applications for IDR and Direct loan consolidation remain down. “The courts have allowed Federal Student Aid to continue implementing the majority of the provisions of SAVE,” says a notice on both application websites. “Borrowers can continue to enroll in SAVE, other IDR plans, and/or consolidate loans. We will keep you notified of any other updates.”

For PDF submissions, “Processing times may be longer than normal,” warns the department. “Please allow at least 30 days for your servicer to process your electronically uploaded application (longer for mail or fax) before contacting them for any updates. We appreciate your patience.”

Student Loan Forgiveness And Repayment Situation Remains Uncertain

While the Education Department’s issuance of the new guidance is indicative of attempts to keep borrowers informed, the situation remains very much in flux. The SAVE legal challenges are ongoing, and the existing injunctions could change as appeals continue. The status of student loan forgiveness under SAVE has not yet been confirmed. And the ultimate fate of SAVE remains uncertain, as parallel lawsuits continue in two separate courts, putting the program in potential jeopardy.
