The Supreme Court on Friday overturned the legal precedent known as the Chevron deference in a 6-3 decision, which will reshape the way that federal agencies interpret laws and craft rules that regulate a wide range of businesses.
For decades, courts have turned to regulatory agencies to fill in the legal gaps when areas of the law are ambiguous--this is the so-called Chevron deference, which emerged from case law.
The Chevron deference resulted from a 1984 case filed by Chevron, a big oil company, which argued that the Environmental Protection Agency's interpretation of the Clean Air Act was overly broad. Chevron lost the case after a judge found that federal agencies are considered to be the authority on a statute if it's ambiguous. That decision brought forth the Chevron doctrine, or the Chevron deference.
The high court revisited Chevron through a pair of companion cases: Relentless v. Department of Commerce and Loper Bright Enterprises v. Raimondo .
It was unclear how far the justices would go in their decision: Some law experts mused that the Supreme Court might rewrite the standard while preserving some elements of Chevron. But on Friday the high court went all in and unraveled 40 years of precedent.
"Chevron is overruled," the justices wrote in the majority opinion. "Courts must exercise their independent judgment in deciding whether an agency has acted within its statutory authority," adding that "careful attention to the judgment of the executive branch may help inform that inquiry."
Business groups, including the Chamber of Commerce, have kept their fingers crossed for it to be scaled down. Instead, they got a complete victory.
The Chamber--which has vehemently opposed recent rulemaking, such as the Federal Trade Commission's noncompete ban --argued that Chevron had given federal agencies too much rulemaking leeway.
"There's been a critique that Chevron has given far too much power to regulatory agencies , and has also given Congress an incentive not to deal with difficult issues -- basically to just kick those issues over to agencies, and let agencies decide," says Jeff Holmstead, a partner at Bracewell LLP.
Stepping away from Chevron now, some legal analysts have argued, could open Pandora's box: What would such a decision spell out for existing federal rules? The counterpoint is that Chevron itself opened up Pandora's box, as Holmstead points out. He adds: "Under our constitutional system, the role of federal agencies is simply to implement the decisions made by Congress, not to legislate in their own rights."
Still, reversing Chevron may be "one of the most significant rulings in decades," according to Chris Roberts, an attorney at Butsch Roberts & Associates, one that could very well water down existing rules from regulatory agencies. "That can create uncertainty for consumers and businesses alike, because where does that leave the state of law, when for so long, everyone's been operating under this understanding that what the regulatory agencies rule are, effectively, the rules that we should be following."
Take the case of the Department of Labor's recent expansion of the overtime pay rule, which is currently being challenged in court in a separate case. The Labor Department previously argued that Chevron deference allowed it to promulgate the rule, but the agency has since stepped away from that argument, as reported by Bloomberg Law.
Paring back Chevron could also reduce rulemaking from agencies--something many businesses will applaud. Senator Dick Durbin (D-Illinois) here adds that the high court's "conservative majority just shamelessly gutted longstanding precedent in a move that will embolden judicial activism and undermine important regulations."
Holmstead, who previously served as the assistant administrator at the Environmental Protection Agency in the George W. Bush administration, believes that the repeal of Chevron will change how federal agencies approach rulemaking.
"No doubt that over time, this will likely constrain agencies and make them more circumspect when they issue regulations," Holmstead says.

Everyone has their own tricks for staving off boredom on a long-haul flight. Some people load up on podcast episodes, others power through the available in-flight entertainment. But no one simply sits, staring silently at the real-time flight map on the screen in front of them, for the entirety of a trip. Right? Wrong. A small group of hardy men—the gender that brought you frat hazing and Logan Paul—are now doing exactly that, and for a variety of surprisingly solid reasons.
A 26-year-old Londoner named West (who asked to use only his first name) went viral in May when he posted about his decision to forgo any entertainment and pass a seven-hour trip watching the flight map. “Anyone else bareback flights?” he asked in the caption.
The concept—referred to in a vivid and perhaps unfortunate parlance as “rawdogging,” “flying raw,” and “bareback”—resonated with many in the comments on West's TikTok page, @WestWasHere . “Yup, from London to Miami this week…pure bareback no food or water,” one wrote. “I swear barebacking flights make it go quicker,” another added.
“I've got DMs on Instagram like, ‘Bro, you need to teach us how to bareback flights,’” West tells GQ .
“I am a nervous flier and generally cannot focus on anything on a plane—movies, TV shows, books, articles, whatever—with any success,” says Luke Winkie, a 33-year-old staff writer at Slate, who has used the flight map as his only in-flight entertainment for years. “For some reason I don't like processing new information when I'm in the air. I want to stick to things that are predictable and safe.”
For West, who has since posted multiple videos from his raw flights (including his longest, a 21-hour slog from London to Perth, Australia), the practice simply resulted from how much he has to travel for his work in the music industry. “I got sick of watching the same movies,” he says. West likens flying raw to meditation. “Visually, you are kind of impaired. You only get to look at the seat in front of you, to your right or left if you're at the window. All you hear is that drumming sound of the engine. It's just white noise.”
But West and others have also come to see rawdogging flights as a kind of challenge, like the Tough Mudder or No Nut November, the goal being to see how fully participants can deprive themselves of creature comforts, up to and including free snack and drinks and even bathroom visits. A true rawdogger takes no indulgences.
West says that the women who have commented on his videos are usually doing so to express shock. Taking flights raw seems to be a “masculine thing,” he says. “Everything's about looking cool. Most guys embrace it as a joke or like, ‘We are so hard. David Goggins has nothing on us.’”
Winkie agrees. “I don't think men have the same ‘treat culture’ that women do, which is frankly a shame,” he says. “A long flight, for women, is the perfect venue to organize an entire itinerary of treats, and I do think men tend to be more stoic and weird about the spaces in which they allow themselves to receive pleasure.”
Still, West says that a recent trip from London from Bali (20 hours) taught him that there are benefits to rawdogging beyond its meditative nature. His best ideas, he says, have come from the time spent locked into the flight map, just thinking. “I'm there like, Oh, we're flying over Afghanistan. Oh, we're going at 36,000 feet instead of 37,” he says. “Or like, Oh, I think that's a good idea as a new series on my TikTok.” The experience left him refreshed. “When I saw my mom [upon landing], she was like, ‘You have so much energy,’” he recalls. “And I'm like, I feel fine. I feel recharged. I feel like I've been able to have time to myself.”
The last benefit may be the most significant: Everyone else leaves you alone. West recalls how a man who was seated next to him in a middle aisle opted to squeeze past two people on his other side rather than disturb West. “He must have been like, ‘I do not want to bother him right now,’” West says with a laugh. “‘He's locked into this altitude.’”

DEDHAM - Karen Read is on trial for second-degree murder in the January 2022 death of her boyfriend, Boston Police officer John O'Keefe. She faces life in prison, if convicted.
But even if she's acquitted on that charge, the jury could find her guilty on two lesser felony charges - manslaughter while under the influence and fleeing the scene.
Defense attorney Phil Tracy spoke to WBZ-TV about the options now in front of the jury in Norfolk Superior Court in Dedham, Massachusetts.
"You would have to intend at that moment, not pre to the incident, but right at that moment, to drive that car into him in order to kill him. I don't believe that's the case under any circumstance," Tracy said of the most serious charge against Read.
"Now, the next two charges do fit the crime that she meant to send him a message about their relationship, or they were fighting that night. She did intentionally or unintentionally hit him, causing his death. Now, that's the manslaughter charge," Tracy told WBZ.
"If you hit somebody and you don't think they're hurt and you drive away, that's the last charge," Tracy said. "It's a very difficult situation because there are so many factors in this case. Number one, the prosecution has proved a pretty good case that she ran over him. The defense has said these people inside the house beat him up and threw him out in the lawn to die. It's kind of a hard theory."
Tracy said the defense has created a reasonable doubt in the case.
"Reasonable doubt is very hard to define. It is not 100%. But it's over 90%. You know what I mean? It's hard to put it in words, there's beyond a reasonable doubt," he told WBZ.
"There's always doubt. There's doubt the sun will come up tomorrow morning. So there is always some doubt about a case."
"They don't want a hung jury, which could happen," Tracy said.
He believes the jury could bypass the murder case because they might find that Read did not intend, at that moment, to kill O'Keefe.
"So now they go down to a lesser charge where her reckless activity caused, backing into him, caused his death and then the lower charge of leaving the scene after causing serious bodily injury," Tracy said.
"I think that the jurors will probably have a difficult time finding her guilty of murder. But, on the other hand, they may include the lesser charges in a guilty verdict."
"This is the difficulty in a case like this. It's a long, big case. If they come up with a hung jury, they're going to have to try it again."

All local eye doctors are now charging ~$100 to give you a copy of your contact lens prescription, which now need to be a year old to fill. I am wearing the same script I got 45 years ago. No reason for this charge. All doctors in the area are doing it. One is even requiring a full "contact lens fitting" the first time you go to them. Clearly also not needed.
Hard to believe that a law had to be written to enforce what should have just been provided as a courtesy all along, but here we are, folks. Glad that they did what was necessary, though, to make sure we get that to which we are entitled. So, bravo and thank you.
In the past eye doctors used to give you a prescription good for two (2) years. Now the same prescription is only good for one (1) year. Did this rule changed? Thnaks
In all commercial matters, ideally, but particularly in all health care services and products, THE PRESCRIBERS should be prohibited from even BEING PROVIDERS. Thus, patients could avoid the conflicts of interest INHERENT in telling a patient what she needs, that, of course, he can "best" provide. Call it the "PARTITIONED" (conflict of interest free) Heath Care System. A Dr. can specialize in diagnosis and even testing and diagnosis, but only some other Dr. with no financial interest in common with the prescribing Dr., can then provide, following the prescription.
I have been wearing glasses since I was two years old in 1956. Today at 71 I have finally moved from glasses that were as thick as old fashion pop bottle bottoms to paper thin lenses due to cataract surgery. This entire lifetime my parents and myself have always received a copy of my prescription without even asking. When I was young I just thought because in case I broke them. As I got older I just decided it was just in case. Now I know there was a more important rule for the eye doctors and it has never been violated

Please ask the FTC to consider regulating how long the prescription is valid for, ie: Eyeglasses prescriptions are valid for up to 5 years from the date written, contact prescriptions are valid for up to 3 years from date written, etc. With this new legal guidelines for free copies, some eyewear providers will try and use the Expires in 6 months or some arbitrary short period to circumvent the free copy rule. Charging fees for additional copies or extending the date, etc. If it is important to have different standards for Children under 18, to have shorter prescription guidelines, then add more details with regards to age recommendations.
My major complaint is that the prescriber insists on doing an eye exam every year when I do not want to , especially when I want to just use the same prescription! Something should be done about that.
The ACA was supposed to give free eye exams & a pair of glasses for children. Good luck with that. It is always a major chore to get it from the VSP which the insurance companies use to send the customers to. This has been a shell game from day one.

Like January in the Gregorian calendar, Muharram is the first month of the Islamic calendar. Per the lunar calendar, on July 7, feel free to wish your Muslim friends “Happy New Year!” However, there’s a lot more to this month. Prophet Muhammad (peace be on him) would fast on the 10th of Muharram (“Ashura”) to honor Prophet Moses (peace be on him) and his people’s deliverance from the Pharaoh’s cruelty. Even today, Muslims are encouraged to fast as a recognition of the world’s oppressed on this day. Coincidentally, almost 50 years after the passing of the Prophet, it was on the 10th of Muharram that his beloved grandson, Imam Hussein, was cruelly martyred by a ruthless despot who had undemocratically taken rule of the Islamic Empire, which served as the death knell to the spiritually inspired successorship to Prophet Muhammad. What then followed was centuries of power struggles and leadership motivated by political conquest in the Muslim world. For this Muharram, amidst today’s global unrest and human misery, consider what a boon it would be for Muslims, instead, to revive a single spiritual leadership promoting Islamic principles of peace and justice!

Muharram, the first month of the Islamic calendar, holds great significance for Muslims. It commemorates Prophet Muhammad’s migration from Makkah to Medina, where he found the Jews in Medina fasting. He said, “I am closer to Moses than Jews.” So, he observed the fast (on that day), and Muslims followed this tradition, an early example of interfaith outreach. Muharram also marks the month of salvation for Moses and the Israelites, who successfully escaped enslavement and persecution in Egypt, after the parting of the Red Sea. The month is especially revered in memory of the Battle of Karbala (in modern-day Iraq) on the 10th day, known as Ashura, in which the grandson of Prophet Muhammad, Imam Hussain, along with his 72 followers were martyred by the army of Yazid, who was cruel and considered unworthy of being Khalifah (leader). This event symbolizes the struggle against injustice and oppression. Today, while Muslims from different sects and denominations commemorate the martyrdom of Imam Hussain, Shia Muslims often express their grief with more intensity. It could be argued the lessons from Karbala are relevant the world over. The month of Muharram is mentioned in the Quran as one of the four sacred months in the Islamic calendar. It has different significances for the diverse Muslim communities. It marks the migration of Muslims from Mecca, where they were persecuted, to Medina and the establishment of the first Islamic state in 622 CE. Also in the month of Muharram, the Islamic religious calendar was established. During this sacred month, warfare is forbidden, and it is said that good deeds are multiplied. So, acts of charity are encouraged. Fasting is encouraged on the 9th and the 10th of Muharram, and on the 10th is done to commemorate the exodus of prophet Moses from Egypt. Muslims celebrate the New Year, but with a solemn reminder of the martyrdom of Master Hussein, grandson of the prophet Muhammad (peace be upon him). For the Shia community, there is more emphasis on commemorating the tragic event leading to the death of the noble master Imam Hussein in the battle of Karbala, a city now in central Iraq. His death marked a very sad day in Muslims’ history.

Daniel Nico Laudit says he does not cry easily. He decided to test his mettle this month in a movie theater in Manila and documented the experience for his 4.5 million followers on TikTok.
Before the screening, he filmed himself dancing and beaming and said to the camera: “Me before watching ‘How to Make Millions Before Grandma Dies.’” About two hours later, he uploaded a very different version of himself: wiping away the tears from his eyes in a bathroom.
“I went straight to the restroom after the movie because I wanted to cry out loud,” Mr. Laudit, 24, a content creator, said in a telephone interview. He said he cried some more when he got back home.
Reactions like Mr. Laudit’s have made the movie, which was filmed in Bangkok mostly in the Thai language, a runaway hit across Southeast Asia. In the Philippines, tickets were sold out on its opening day, theaters had to add more screenings to meet demand, and one chain started handing out tissues to viewers. In Singapore, it topped the box office from June 6-9. In Indonesia, it has drawn millions of viewers. In Thailand, it is the highest-grossing title of the year so far.
The plot revolves around an aimless and unemployed young man, M, whose sole ambition is to livestream his online games. He volunteers to take care of his maternal grandmother after he finds out she has Stage 4 cancer. His motivation is not filial piety; instead, he hopes that he can inherit her house.
